By using this site, you understand that you are viewing copyrighted artwork, and you understand that unless provided with express written permission by the artist, you are not permitted to copy, sell, alter, download, revise or edit any of the images in this site.
By purchasing artwork from this site, you understand that you are making a purchase using the same, common standard encryption methodology (SSL, Secure Socket Layer) employed by most ecommerce sites in the USA. Notwithstanding anything to the contrary in these Terms, Jane Ball Photography makes no warranty or guarantee that your use of this site will be uninterrupted, error free, or free of viruses or other harmful code. Jane Ball Photography shall not be liable to you for your use of this site or any claims or damages related to or arising therefrom.
This site may contain links directing you to other websites. We make no representations concerning any content contained in or accessed through the site, and we will not be responsible or liable for the accuracy, copyright compliance, legality or decency of material contained in or accessed through the site.
By using this site to view and purchase artwork, you understand that you are assuming responsibility for your viewing and purchases. By using credit cards, debit cards or other third party payment systems you are attesting to the fact that you are the owner of or duly authorized to use such payment method and are able to complete purchases with funds available to transfer to the artist. You further understand that no purchased artwork will be shipped until purchase funds are fully cleared by the artist’s financial institution.
By purchasing art on this site, you understand that all sales are final. Purchased products are shipped with either, in the artist’s sole discretion, (1) insurance provided by the shipping carrier that equals or exceeds replacement value of the purchased product in the event of damage in transit, or (2) the artist’s guarantee that damaged products will be replaced. In the event you determine you do not want to keep the purchased artwork, you understand you cannot return it for a refund, transfer of value, or credit toward a future or alternative purchase.
By purchasing art on this site, you understand and accept that you may transfer ownership of the art to another person(s), but you may not alter, transform or edit the art without express written consent from the artist. If the art purchased is on a canvas stretcher, the purchaser may remove or alter the stretching frame so long as it does not alter, edit or otherwise transform the art. The artist’s copyright persists, no matter how many times purchased or gifted art changes ownership, nor if any mounting medium or physical frame is changed.
The artist reserves the right to adjust pricing of art at any time, for any reason, without giving prior notice. Artwork purchased at a price that is decreased at a later date does not entitle the purchaser to a refund of the difference, nor entitle the purchaser to a credit against future purchases.
When you create an account on this site, you understand that you are providing personal information voluntarily that we may use to contact you, unless you expressly opt out of our being able to do so. We do not retain any credit card, debit card or other payment processor information. We do not transfer, sell or otherwise share any personal information you provide to us except as is necessary to process payment for and deliver any art purchased on this site. Our email lists are never sold, transferred or otherwise shared.
